Rules and guidelines for acceptable use of the platform.
Effective Date: January 1, 2026
Last Updated: September 29, 2026
This Acceptable Use Policy ("AUP") governs all communications, workflows, and messaging generated through the Xmellow platform (https://xmellow.com), operated by XRYTE BYTE TECHNOLOGIES LLC.
Compliance with this policy is mandatory. Violations will result in immediate suspension or permanent termination of your account without a refund.
1. Mandatory Consent & Anti-Spam Standards
- Verifiable Opt-In Required: Every contact imported into your sub-account must have provided clear, documented, and verifiable consent to receive communications from your specific legal business entity.
- Prohibited List Sourcing: The use of purchased lists, rented lists, third-party lead databases, shared lead registries, web-scraped directories, or co-registration lists is strictly prohibited.
- Mandatory Opt-Out Mechanics:
- All outbound text messages must recognize and immediately process standard opt-out keywords (STOP, END, CANCEL, UNSUBSCRIBE, QUIT).
- All marketing emails must include an active one-click unsubscribe mechanism and display your valid physical business address in strict compliance with the CAN-SPAM Act.
Circumventing, disabling, or altering system opt-out workflows is a material violation of this agreement.
2. Prohibited Industries & Messaging Categories
Mobile carriers and telecommunications providers strictly prohibit specific traffic categories. You may not use Xmellow to market, promote, or communicate:
- SHAFT Traffic: Sexually explicit materials, Hate speech, Alcohol, Firearms, Tobacco, Cannabis, CBD, Hemp, or Vaping products.
- High-Risk Financial Services: Payday loans, cash advances, title loans, credit repair services, debt relief/settlement, or cryptocurrency sales.
- Third-Party Debt Collection: Attempting to collect purchased, defaulted, or third-party debt.
- Deceptive Systems: Multi-level marketing (MLM), pyramid structures, affiliate lead aggregators, or speculative investment schemes.
Phishing & Fraud: Unauthorized brand impersonation, spoofed headers, distribution of malicious scripts, or data harvesting.
3. A2P 10DLC Carrier Registration
All users conducting commercial SMS/MMS messaging within the United States must register their business profile under Application-to-Person (A2P 10DLC) regulations:
- Subscribers must submit accurate, legitimate corporate information, physical addresses, and Employer Identification Numbers (EINs).
Sending commercial text messages across unregistered numbers or attempting to evade carrier campaign filters will result in immediate suspension.
4. Deliverability & Performance Thresholds
Accounts exceeding the following thresholds are subject to automated sending throttles, review, or suspension:
- Email Hard Bounce Rate: Exceeding 5.0%.
- Email Spam Complaint Rate: Exceeding 0.1% (1 complaint per 1,000 sent emails).
SMS Carrier Filtering Rate: Sustained carrier rejection rates exceeding 5.0%.
5. Account Penalties & Carrier Fine Pass-Through
- Zero-Tolerance Termination: Accounts terminated due to spam violations, carrier complaints, or AUP non-compliance forfeit all subscription payments and wallet balances.
Carrier Fine Pass-Through: In the event that a cellular carrier (such as AT&T, T-Mobile, or Verizon) assesses monetary fines or penalties resulting from your unauthorized, illegal, or non-compliant messaging, those fines will be billed directly to your payment method on file.
